How do I know if I qualify for alimony?

Not every marriage is going to be one in which a party qualifies for alimony. Alimony is looked at as need and ability. Does the person actually have a need to receive it and does the other person actually have a need or an ability to pay it? The second factor that’s looked at is the length of the marriage. There’s short, moderate and long-term marriages. Those factors all come into play.

When you do hire an attorney, it’s very important for that attorney to break down your financial situation into a financial affidavit that really reveals either the need to receive it or the ability to pay the alimony. Then we can look at the length of the marriage and other factors that may or may not come into play such as disability or other financial needs that would be extraordinary.
