What happens to joint debts when we divorce in Florida?
Generally, the debts will be divided equally. However, if one spouse is going to be unable to pay for the debts while the other one has ability to pay for the debts, the courts may shift the debts from one party to the other in order to create a more fair balance so that nobody walks out of a divorce broke. Nobody walks out of a divorce where one party has a great ability to continue to earn while another party is saddled with no ability to earn and all the debt.
