What is probation?
Probation is a period of time where you’re under the court’s supervision. The courts use the Office of Probation to supervise you. During the time that you’re on probation, you are subject to the court’s whims. In other words, if they want to do a search of your home, they do a search of your home. If they want you to report certain days, you must report, you have to pay the fines and the fees while you’re on probation.
If you violate probation, you’re not given a trial on the original charge, you’re given a hearing with no jury, just the judge, on whether or not you violated your probation, and it’s not beyond a reasonable doubt, it’s just a preponderance of the evidence. Can they show it’s more likely than not that you violated your probation?
